I had a 12ga Japanese A5 on Armslist, local sale, I stated I would not ship. This is in the Atlanta area.

I received an email from a guy, he stated he lived in N. Tennessee. The town is about half way between Nashville and the KY border. He said he would make a special trip just to buy the A5. That is at least a 4 hour drive with no stops and keeping your foot down. It's a very nice A5, but it's just an A5.

I emailed back and stated I would only sell to a Ga resident. He replied and said "well, my brother is a Ga. resident". I didn't bother to reply.

I'm not too worried about out of state buyers, I would always ask for a current GA. driver's license before selling and list the license number on the bill of sale.

But what are the responsibilities for a private seller on straw man purchases? How careful (or paranoid) do you have to be? The whole incident was a little bizarre. I don't intend to sell to anyone who isn't the intended recipient of the gun.

Nothing illegal about selling a long gun to someone across state lines.

Ok, well, I thought you had to do a FFL transfer to a resident of another state.

Slightly off topic, but just FYI, I have had better luck with the Outdoors Trader for buying and selling in the Atlanta area. When I posted something on Armslist, I got a lot of weird spam, I have also seen ads on there that were clearly fraudulent. Seems like they have no protocols in place for vetting buyers or sellers.

I know I can ship to an FFL in TN. This guy wanted to drive down and take the gun back with him in a private sale.

From the ATF website:

"May an unlicensed person acquire a firearm under the GCA in any State?

Generally, a person may only acquire a firearm within the person’s own State. Exceptions include the acquisition pursuant to a lawful bequest, or an over–the–counter acquisition of a rifle or shotgun from a licensee where the transaction is allowed by the purchaser’s State of residence and the licensee’s State of business. A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes."

You are required to take into account the term "No reason to believe." I sold my Model 12 listing in the local paper and a guy called and asked if that was a semi automatic after just telling me he has been hunting for 20 years. I said you have been hunting for 20 years and you never heard of a Model 12?

I said the gun is sold,(it wasn't) and said good bye. I'm the private seller and its my decision whether I sell you the gun or not. I don't care if that's paranoia or not its my decision.

You can sell to the resident of a contiguous state, if there is an agreement between the two states to allow it. I think Ga. and Tenn. have this agreement.
