Obtain and send are two different things right? So non license shipping to dealer ez system can be used in lieu of a FFL copy for the non licensed party. Obtaining a firearm is something totally different.

Right. We're not talking about acquiring a firearm. We're talking about verifying an FFL before SENDING a gun.

Again, the law is that FFLs must exchange license copies. The law does not require FFLs to provide copies to unlicensed persons. The EZ Check system was set up, in part, to allow unlicensed people to verify the validity of an FFL. The ATF specifically recommends that how these sorts of deals work. What is so hard about this concept?

FFL to FFL, the two parties are still expected to exchange license copies. (That said, there is no requirement for an FFL to RETAIN said exchanged license copy. If an FFL were to write down the EZ Check detains about the sending FFL in his A&D book without actually having received a "certified copy" the ATF would be none the wiser.)

One more thing on this license vs. EZ Check thing . . .

Anyone with Photoshop skills could easily fake or alter an FFL. Grab a good one off the Internet, change the address. Done. A faker is not going to be able to produce an EZ Check verification.

In August In was in the ATF office in Houston

I have some personal guns that are not corporate guns

I already knew the answer but asked anyway about selling/ shipping out of state

The agent said if you sell/ship out of state you must verify that you are shipping to an ffl dealer

Even if you abolished the GCA of 1968, which is a great idea, you would still have to contend with a myriad of local and state laws which are typically imposed in Liberal Democrat strongholds. Take a look at what is happening in Virginia right now, since Democrats recently gained control of the legislature:

The other problem is that many FFL's and many gun buyers are simply too lazy or too stupid to read and understand the laws. You have FFL's like Ed Good who refuse to transfer pre-1899 Antiques without an FFL transfer, and you have FFL's who will not accept a firearm from an individual, even with a copy of a drivers license. You have guys right here who need to have it explained multiple times, that the FFL E-Z Check system is merely a means to verify that someone is actually an active licensed firearms dealer... nothing more.

The thing that always amazes me is how often unlicensed folks are so determined to follow rules that were written for people who hold FFLs. They make this so much harder for themselves by worrying about things that don't affect them.

The ONLY thing that matters in a situation of a private transfer is that both parties are satisfied. Once the deal is done, the unlicensed seller doesn't have to keep any records or be able to prove anything. No, it's not quite handshake and done, but it's pretty close. There's no reason to get all wound around the axle over it. Yeah, the receiving FFL has to have all his ducks in a row, but the unlicensed parties are not accountable to anybody (OK, that may not be true in California and New York, etc.).

If the receiving dealer doesn't want to provide a license copy, fine. He doesn't have to, and you don't need it. Do the EZ-check thing. Google image the address storefront if it makes you feel better. Talk to your buyer. Then move on. Do the deal and get it done. Relax. It's OK. If you're not an FFL, you don't have to pretend to be one.

Regarding an interstate transfer, is an unlicensed sender required to provide a driver's license to the receiving FFL?
