Unethical hunting pure and simple. Probably wounded more than he killed. Edited out of course.
If I saw someone using that or similar I would call the game warden. I'm only with you partly, he probably did wound many ducks but we also do that with our shotguns. Unethical I'm not sure. What is ethical? In your neck of the woods its one thing in mine another Ethical has little meaning in my life. A quick kill with minimal suffering is what I strive to achieve whether for birds or big game.
Nothing is foolproof to a sufficiently talented fool.

I agree right there and that's what I consider one of the basics of ethical hunting. Using the correct tool to try and achieve minimal suffering.

No bans. But I would question your sanity if you hunt Canadians with one.
