just had an interesting conversation with a lady at atf headquarters in dc...
she advises there is not federal regulation that prohibits the interstate shipment of a shotgun as a gift from one individual to another...

Here's what the ATF actually has to say about private transfer of firearms both in state and out of state. Pay particular attention to paragraph 2 which addresses gifts to someone out of state: TRANSFERS OF FIREARMS BY PRIVATE SELLERS
An unlicensed individual may transfer a firearm to another unlicensed individual residing in the same State, provided that he or she has no reason to believe the buyer is prohibited by law from possessing firearms. For a list of categories prohibiting a person from possessing a firearm, please refer to 18 U.S.C. 922(g) and (n).
An unlicensed individual is prohibited from directly transferring a firearm to a person residing in another State. Regardless of the purpose of the transfer (e.g. gift, trade, loan, sale, ownership, etc.), this restriction applies to all types of firearms.
An unlicensed individual may complete a transfer to an out-of-State person through the following procedure: • The unlicensed individual transfers the firearm to a Federal Firearms Licensee (FFL) located in the State of the person receiving the firearm . • The FFL will transfer the firearm to the unlicensed out-of-State person. • The FFL will be responsible for lawfully transferring the firearmThis is from an ATF Publication titled "BEST PRACTICES: TRANSFERS OF FIREARMS BY PRIVATE SELLERS" Here is a link to the ATF Document: https://www.atf.gov/file/58681/downloadDon't leave now Geo. the guidelines memo referenced above does seem to be a contradiction...as there is no federal statute prohibiting the interstate transportation of a gifted shotgun...
guess best course is to err on the side of caution...and ship it to a ca dealer...

After 5 pages and the question still has not been answered I guess my next shotgun I list will state no California sales. I thought it was as simple as taking the gun to a local FFL dealer and having him send it to another licensed FFL holder in California. That is if the California FFL guy would not process using a copy of my drivers license. When the Double gun brain trust can't figure it out us regular guys don't stand a chance.LOL.

The question was answered within the first couple of replies, some, like myself, were just expressing their exasperation of the federal and state regulations not only in California but elsewhere.

You do NOT need to ship it from an FFL. Just pack it and ship it TO a CA FFL of your son's choice. Period. End of story. It's that simple. Even for shipments to CA. Not complicated. Geeze.

More and more FFL holders will not receive a gun sent directly to them from an individual. All they really need is a copy of your DL., but many are refusing to accept guns without it coming from an FFL.
Replacement you are spot on. The transfer is straight forward. My tongue in cheek comment was to point out why some are not selling into California after pages of comments and debate on a simple question. " cobbhead was on track he told his son to find a local FFL and he would ship the gun. He asked if there would be any problems. The answer should have been NO. That's the proper way to start. Cobbhead hope you have already shipped your boy a replacement shotgun so he can put the loss of his gun behind him and start shooting ducks before Christmas.

Still waiting to ship the gun to my son. Unfortunately he lost not only his gun, but most of his decoys, a boat, shells, misc. clothing and a thermos. He was hunting a river and had to swim to shore (in waders). Couldn't even call for help 'cause his cell did drown. Lucky to come out with his life! He should get his cell today and will contact a local FFL. I'll have him hunting again by New Years. Thanks for all the information, I'm much less concerned about shipping to CA now.
