Bob, From what she said as reported above she seems to have written you a check refunding your money and mailed it "slow post" to you. If it shows up and if I were you I'd deposit it and forget the whole thing. Look for one of the other 5 B-grade 20's which are supposed to exist. You won't likely get satisfaction through the law. You may not even have a cause of action given the totality of the circumstances. JMHO...Geo

Unfortunately, the Postal Inspectors are in the business of investigating crimes including scams involving the mail. A successful investigation and prosecution of a scam does not necessarily put money back in the victim's pocket. If you get a refund, it probably makes sense just to move on.

Bob,Good advice above. I believe she will ultimately return your money. If the money doesn't show up within a week or so you can re access your options.

She has lied to me so many times now I don't know whether she did return the money or not. The purpose of this post is to prevent somebody else from going through the same ordeal. I am not saying don't buy the gun. Just do it though a licensed FFL who has possession of the gun prior to any transfer of money. And beware that there are some issues with the gun that are more than just "normal use" as was described to me.

She was getting the worst of it on her FB page. As I was commenting on her posts deriding DrBob, she deleted them -- including several other responses she didn't like. In the deleted exchanges she said she sent a refund and that made everything ok. So I put this into a new post on her page. I'm sure it will soon be deleted too.
"When you cashed the certified check you confirmed an agreement to sell, and were obligated to deliver the gun. Instead you held his money in your bank account while trying to sell it to someone else who'd pay more. Responding with outrage at being fraudulently used is not the same as bullying. You're a fraud."

I second Geo's free legal advice. If you get the money back you have learned a valuable lesson and have broken even.

You guys are more forgiving than I am these days about issues like this. I understand the forget about concept. I also hate to have someone jerk me around and think that it is OK. To many here are general lawyers and not real ones. Some that (lawyers) are are trying to give very generic advise and I understand their point that they do not know everything that went down. Ten grand or more is a major amount of money in the eyes of most courts for possible fraud. the ground she is on is thinner than she suspects I think. I knew a congressman who went to federal prison for a $250.00 mail and wire fraud. A ditz would be in real trouble with that type of judge.
I was banned from GB for over a year while I worked through a fraudulent seller and two gun deals that went south. GB was absolutely no help. In the end I got my money back, the seller is banned from GB and has lost his FFL. So for a year I could not use GB. Now they have "reinstated" my privilege to spend money. Unless the seller can get listed under someone elses name he is done with GB and I suspect he never will get a FFL again.
How much grief do you want to put up with and put out.

Dr. Bob: One thing that you might consider, if you can afford to do so, would be to hire someone to walk the sidewalk in front of her store with double sided placards detailing exactly what happened with you and the gun. Be sure that what it reads is all true & exactly as it happened. I am sure that this will produce results.
Best Regards, George

Well, I'll be damned. A certified check arrived today for the full amount. That is one lesson learned, but fortunately it didn't cost me anything more than a few hours sleep. I would advise anybody who does look at trying to buy that gun to do it through a licensed FFL.
