Won an auction recently on Gunbroker pre-1898 SxS. Went to pick it up at the post office and was pleasantly suprised to see it packaging in great shape (I always worry) and when I opened it up I found it to be in "as described condition" with alot of case colors and the bores were nice. The barrels were in good condition as was the wood. All the good things that we all want in our latest purchase EXCEPT it was described and advertised as a 28 when in fact it was a 16 gauge.
I paid more than it was worth because of the gauge and would have paid more were it really an early 28. What would proper protocol now be? The seller has over 500 sales and an A+ rating thru Gunbroker. Which also makes me question how a 16 could be mistaken for a 28 (maybe a .410 or a 20 but not a 16). Just for the record I did save all correspondence and the gun is referenced as the 28 gauge several times in each e-mail.
He's away hunting so I have yet to bring it to his attention. Just thought I'd get others experiences to have as reference before I contact him.

Seems pretty cut n dry. He sold it as one thing and when you recieved it turns out to be something else. Contact the guy and get your money back. Anyone who cant tell a 28 from a 16 shouldnt be selling in the first place imo.

Ironman: I bet the bloody bastard is "away hunting." More likely spending your cash in Vegas.
Nonetheless, Gunbroker has a solution. You can get a whopping $400 cash back in case of fraud. Of course, you have to wait 30 days. Good luck mate.

Shouldn't be any problem. It was misrepresented and bought by you, based on the wrong description. If he has an A+ rating, I'm sure he'll take it back. Be sure to print the ad description, to backup your case. Maybe he sent you the wrong gun??? Let us know how it turns out. Best wishes with it.

Sounds like my own most recent (and ONLY bad) GunBroker experience. I buy Remington model 17s whenever I see a good one at a decent price. This one was clearly described as having 28" barrels marked Modified choke. It showed up with a 30" Full choke barrel numbered to the action. The gun is clearly the one pictured in the ad. I contacted the seller to see if maybe he had the 28 inch barrel he advertized...no response. Any of you long barrel fans out there want to swap a good 26" IC Model 17 for my new 'Long Tom'?...Geo

I'd need to hear what the guy has to say. He certainty should know the difference between 16 & 28. But if he made a mistake and admits he made a mistake and gives you your money back including shipping costs then he is a stand up guy. I can't imagine how someone thinks they can send you a 16 for a 28 and expect to get away with it. I hope there is a fair explanation. Let us know how it goes.

I had a GB deal that went south last year. Gun was a 10 not a 12 as listed and described. Seller answered emails before sale but his answers were outright lies. Tried every thing to get the gun returned to the seller. He did not answer the phone, ignored emails, and then refused the package when I returned the gun to his FFL. So much for the agreed upon three day inspection period. Refused to refund my money. Refused to admit that the gun was a ten bore instead of a 12, like they swell in shipping. The fact that he described the gun in far better condition than it was is no surprise.
Sent multiple emails to Gunbroker, no real response or help. The seller ended up giving me a bad feedback. I got dinged and GB did squat. So it will be a cold day in H... before I give GB anymore money by using them. There are too many places to buy guns to have to put up with this level of bad service and out right dishonest business practice. Hope your sale ends up happier than mine did.

I always make sure that I have their home address, which I check over the internet.
Then I let them know, that "I know where they live." without using those words. Then I send them a certified check.
Any issues such as you describe, I advise them that they have committed Fraud using the US mail system, which is a Federal offense. Then I contact the FBI and send him a copy of the letter.
Works every time.
