You buy a shotgun from some one on the net and send $ for the gun + shipping + insuracne. Gun arrives and it has been broken in transit, cracked up stock or bent barrel but is otherwise as advertised. You don't want it.

Do you send the gun back to seller and get all your money back, seller wait's for the insurance?

Let us say the seller says 3 day inspection does not apply since gun was shipped as described, it is your gun after it left his ffl and you deal with insurance. How do you handle that?

The shipper will have the insurance receipt unless he sends it with the gun, which makes no sense. The receipt holder must file the claim according to the USPS.

No, it is the seller's problem. Not yours.

If you ordered a pair of boots from Cabelas and they arrived in pieces - what happens? You send them back and Cabelas reships or refunds.

Only the sell can settle with the shipping company.

I see this occasionally in auction descriptions. If the rules of the website say there is an inspection period the sell can't just make his own rules. That is a big red flag when it see a statement like that.

It really becomes the buyer's problem since the seller has already received the funds and the buyer has a broken product. How are you going to make the seller go through the time consuming process of getting the carrier to pay their dues? Or to get the product back and go though the same process of carrier insurance.

I'm pretty sure the seller/shipper is the only one that can collect the insurance.

Joe you are correct. The insurance receipt will have the sender's/insurer's name and address on it. That's the only person that can file a claim.

All keep in mind your not dealing here with cabela's. Seller says gun was o k when shipped. Certianly he will file a insurance claim and send the $ to you when he gets it. In most cases does'nt this become the buyer's problem if dealing with internet seller or small time gunshopp? Options if it happens to you?
