They know and did not let that stop them from letting their views get in the way of the facts. The problem is with the style of judicial activism that is taught in law schools, too many judges become activist in ruling on cases. They do not interpolate as much as try to fix or dictate, what should be, in their learned view that the law should be. They do not even seem to use the Constitution as the guiding light in their rulings. By becoming "activist" they assume the role as law makers and even the executive branch. If they want to make law they should run for elected office not hide behind the robes of the court.
One swing vote will reverse the last ruling in this case. We are not done with the issue as many think. They will just try another tact and get a ruling that will make their case seem reasonable and hence get a back door way to get what they want.
This is why I am voting for the most conservative Presidential candidate that has a chance to get elected. And he is no conservative by any means. But what choice do I have? Vote for the other candidate and get two or three liberal judges appointed in the next term or two terms. Stack the Supreme court 6:3 against and we are in real trouble. And that is a fact. ATIAF
