Just FYI, no you do not have the right to the insurance money and the gun. If you are involved in an auto accident that is bad enough to total your car, it belongs to the insurance company. The towing company will even protect the insurance company from you from getting into it. Alot of times it will even be hard for you to get personal belongings out of it.
Oh you also do not have a choice on repair or replace. If they are willing to give you the fair market price the auto is gone and all you will have is a check.

A FedEx customer dosen't really buy insurance. He ups his declared value from the basic $100 to a certain amount, and then pays additional fees for the carrier to be liable for the extra amount in case they destroy or damage his shipment. It's up to the customer (shipper) to prove damages, and there are exceptions and exclusions. This is outlined on the back of the Fed Ex airbill, available at any Fed Ex drop box (and probably on their website). This constitutes an agreement between the shipper and the carrier.

UPS and FedEx are both in the 'criminal' category when it comes to paying damage claims.
Note that James Julia auctions uses an independent third party insurer when they ship firearms due to poor eperiences with Fed Ex and UPS insurance.

I have been using USPS reg. mail for returning client guns for the past 7 years --- I have never had a problem with returning packages or receiving them. I ship 2 - 4 packages a month. when are you guys gonna learn ??? UPS and FedEx have a bad rep -------

I've got this sinking feeling that I'm not going to be pleased with the outcome of this matter. The guy on the other end is assuring on the phone with no followup to resolving this. I'll keep you posted, but it don't look good. Thanks for your replies. Randy

If it was not shipped in a hard case inside another box you will NEVER collect the insurance claim. Fedex nor UPS will pay if not packed this way.
I have several claims on going at most times and they will jerk you off to the end. The shipper is the insured not you the receiver.
You should send the gun back to the seller for a refund as it is not acceptable broken that is your recourse. It should be within the 3 day inspection period. if you bought of the internet. If you bought from an auction house formal complaint to the State auction board..
