I have a gun due to arrive at my FFL tomorrow or Thursday. If it arrives Thursday I can't make it to the shop in time to pick it up because of a lodge meeting. Can my fiance pick it up? I seem to recall a question on the form that asks if I am the purchaser of the firearm. Previously, I have always picked the gun up and could answer "yes". What happens if she says no? Your help would be much appreciated since I'm trying to get the gun before Friday's hunt.

You need to pickup the gun from your FFL. There is a uestion that is on the form and it is intedned to catch straw purchasers who are buying for others. Some of the others are not allowed to buy guns and use straw purchasers to buy what they want. He needs to deliver it to you as you are the buyer, not your better half. Some may not agree but rules are rules, some dealers may let it slide if they know you very well and just deal with the paperwork the next day. If caought they could well loose their FFL. Never post that a dealer does that for you as big brother is watching.

I believe she would have to say "no" to be legal. You'd better figure out a way to get there yourself unless you can convince the FFL holder to bend the law for you. He has to run the background on you and you have to sign the form after answering the questions. If you want the gun badly maybe it's more important than the lodge meeting, for one night. You might be able to get around this if she says she is buying the gun as a gift for you. Sarah Brady bought a gun for her son this way. See note 1 on the form.

Thanks guys. No sense in making this more complicated than it has to be so I'll make an effort to get up there myself. Will have to suffer and use another one of the guns in the safe tomorrow. Oh well, as long as we're out hunting.....

Of course not. The first part of my reply gave him my best answer. Nowever, I'm taking for granted that GSPizzy is not legally prohibited from buying or owning a firearm himself. If that's true there's no reason, under the intention of the law that she can't buy the gun as a gift for him. To Shooting Star: The reason I mentioned the Sarah Brady situation is because when it was in the news that she bought a rifle for her son there was a bit of a flap going 'round that she might have broken the law by buying a gun for someone else. This was the first time some of us realized you COULD buy a gun as a gift and be OK with answering "no" to the question about the gun being for yourself. Not suggesting she "is a great mom". She's an Adam- Henry, IMO.

That isnt bending the law, thats breaking it. Right or wrong, what you think doesnt matter in court. That would be considered a straw purchase and the way the laws are usually interpreted, it isnt on behalf of the gun owner. If your dealer even considers it he is nuts. I wont do it with any of my customers. My FFL is too important.

Well, as it turns out the gun didn't arrive today even though I made arrangments to go pick it up. Just my luck. It'll arrive tomorrow while I'm out with the dog. Now my beef is with the dealer.
